O R D E R

This writ petition has been filed by the petitioner to direct the respondent to grant permission and necessary protection to perform the cultural programme namely Karagattam on the eve of Arulmigu Sri Sappani Karuppu, Sri Ondi Karuppu and Arulmigu Sri Selvakaliamman Temple Masi Festival at Edamalaipatti Village, Trichy District which is to be held on 13.03.2018 from 10.00 p.m to 12.00 p.m.

2.Heard Mr.T.Senthil Kumar, learned counsel appearing for the petitioner and Mr.N.Shanmuga Selvam, learned Additional Government Pleader appearing for the respondent.

3.The learned counsel appearing for the petitioner has submitted that the petitioner is one of the Villagers of the said Village. The villagers are conducting the "Karagattam" programme for the past several years and this year, they have decided to conduct the "Karagattam" programme on 13.03.2018 and for that, they have already given the representation dated 05.03.2018 to the respondent, but so far, no order has been passed. Hence, he has filed the present writ petition.

4.The learned Additional Government Pleader appearing for the respondent has submitted that there is a law and order problem and hence, the petitioner's representation is kept pending. 5.Considering the aforesaid submissions, the respondent is directed to consider the representation submitted by the petitioner, dated 05.03.2018 and dispose of the same at early. At the time of passing order, the respondent has to keep in mind the decision of the Hon'ble Supreme Court of India in the case of Church of God (Full Gospel) in India Vs. K.K.R, Majestic Colony Welfare Association and Ors, reported in 2001 - 1 - L.W. (Crl.) 233. 6.With the aforesaid observations, this writ petition is disposed of. No costs.
