M. P (MD) No. 902/2017 in Crl. R.C(MD) No. 105/2017 dated on 09.02.2017 on the file of this Honourable Court.

PRAYER IN CRL RC(MD)NO.105/2017 :

To set aside the order dated 16.12.2016 made in M.C.No.8 of 2015 on the file of the Family Court, Sivagangai, and allow the Revision Petition.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.SARAVANAKUMAR, Advocate for the petitioner and of MR.S.GOKULRAJ, Advocate for the Respondent the court made the following order:- The learned counsel for the petitioner / respondent and the learned counsel for the respondent / petitioner are present. https://hcservices.ecourts.gov.in/hcservices/

2.The respondent / petitioner was directed to deposit 50% of arrears of maintenance amount to the credit of M.C.No.8 of 2015 on the file of Family Court, Sivagangai as per order in Crl.M.P.(MD) No.902 of 2017, dated 09.02.2017 and the said condition was properly complied with. Hence, interim stay already granted by this Court was made absolute on 16.03.2017.

3.The learned counsel for the respondent / petitioner has no objection to withdraw the deposited amount by the petitioner / respondent.

4.Hence, the petitioner / respondent is permitted to withdraw the deposited amount on filing proper application before the Trial Court. Accordingly, this petition is allowed. sd/- 13/10/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
