Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to Suspend the sentence imposed on the petitioner by the Honourable Learned 2nd Additional Special NDPS Court District and Sessions Judge, Madurai vide in C.C. No. 1247 of 2003 dated 23.6.2016 enlarge the petitioner on bail pending disposal of the Crl.A.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S R.BABU JAGANATH, Advocate for the petitioner and of MRS.P.KANDASAMY,Government Advocate(Crl.Side),on behalf of the Respondent, the court made the following order:- Mr.R.Babu Jaganath, the learned counsel for the petitioner is present. Mr.Kandasamy, the learned Government Advocate (crl.side) for the respondent is also present.
2. Heard both sides.
3. It is admitted by the learned counsel appearing for the petitioner that in the petition for suspension of sentence it has been mentioned that the fine amount has been paid.
4. The learned II Addl.Spl.Court for NDPS Act Cases, Madurai, has informed to this Court by a letter D.No.960, dated 09.11.2016 that the fine amount has not been paid, as stated in the orders passed by this Court.

5. The learned counsel for the petitioner prays time to deposit the fine amount before the concerned Court.
6. The learned Government Advocate (crl.side) for the State, raised objections stating that the counsel for the petitioner misleaded the Court that the fine amount was paid.
7. Considering the nature of application moved by the petitioner and also the order passed by this Court, this Court is inclined to direct the petitioner to deposit the fine amount before the Court concerned, within a period of four weeks from today, failing which, the order of suspension will be revoked and the order of suspension already granted is ordered to be kept in abeyance, till the date of compliance.
