The present writ petition has been filed seeking a Mandamus directing the second respondent to implement the order of the first respondent dated 09.12.2022.
2. A perusal of the averments in the affidavit reveals that one Durai Saravanan had filed his nomination for the post of Councilor in Ward No.5 of Paravai Town Panchayat, during local body elections of the year 2022.
3. According to the petitioner, he contested the election as an independent candidate. The petitioner further avers that Durai Saravanan was a successful bidder for supplying pipes for the Paravai Town Panchayat during the declaration of local body elections and therefore, he was ineligible from contesting the elections. However, his nomination was accepted and he contested the elections and he was declared as a successful candidate.
4. The petitioner has lodged a complaint to the first respondent to initiate action as against the said Ward Councilor under Section 50(1) (d) of Tamil Nadu District Municipalities Act, 1920, and the first respondent had 2/5
forwarded the same to the second respondent on 09.12.2022. The present writ petition has been filed seeking a Mandamus to direct the second respondent to implement the order of the first respondent.
5. The averments in the affidavit clearly disclose that the said Durai Saravanan has not incurred any disqualification after he was elected as the Councilor. But the allegations in the affidavit disclose that his nomination was wrongly accepted. Therefore, it is clear that the only option open to the writ petitioner is to file an election petition before the competent court and he cannot seek disqualification of the elected candidates.
6. In view of the above said deliberations, there are no merits in this writ petition. Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
