PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the 2nd respondent to produce the body or person of petitioner's daughter and son Minor.Riya sri, D/o.Chandran and Minor.Muthur, S/o.Chandran before this Court and hand over the custody to the petitioner. The petitioner seeks for production of the person of the minor children viz., Riya Sri and Mithun.

H.C.P.(MD) No.323 of 2022 3.According to the petitioner, the third respondent has detained them illegally.

4.The learned Additional Public Prosecutor appearing for the State, upon instructions, would submit that the wife of the petitioner is living with the third respondent along with the children on her own volition and divorce proceedings in H.M.O.P.No.8 of 2022 are also pending before the jurisdictional Sub Court. 5.In view of the above, we do not see any case of illegal detention to entertain the Habeas Corpus Petition. Hence, this Habeas Corpus Petition is dismissed.
