ORDER

The petitioner / accused in SplSC.No.07 of 2022 on the file of the Principal Special Court for Exclusive of Cases Under the POCSO Act, Sivagangai was found guilty, convicted and sentenced to undergo 3 years rigorous imprisonment with a fine of Rs.5,000/-, in default, to undergo 1 month imprisonment for the offence under Section 7 r/w 8 of the POCSO Act. As against the conviction, the petitioner has filed an appeal in CrlA(MD)No.217 of 2025. Along with the appeal, the petitioner has filed this miscellaneous petition to suspend the sentence pending the appeal. 1/3

2.Though the petitioner's sentence was suspended till 21.02.2025, the petitioner has not surrendered after expiry of the same. 3.Considering that the petitioner has not surrendered even after the expiry of the suspension period granted by the trial Court, this Court is not inclined to entertain this petition.
