Criminal Original Petition filed under section 482 of the Code of Criminal Procedure, praying to call for the records relating to the case in M.C.No.21 of 2012 on the file of the learned Judicial Magistrate No.I, Thoothukudi and quash the same. For Petitioners : Mr.C.Moorthy - - - - -

O R D E R

The Criminal Original Petition is filed praying to for the records relating to the case in M.C.No.27 of 2014 on the file of the learned Judicial Magistrate, Nilakottai, Dindigul District and quash the same.

2. Heard the learned Counsel for the petitioners.

3. Two points have been raised by the learned Counsel for the petitioners. Firstly, as against, apart from the first petitioner, no specific allegations as against the other petitioners. Secondly, the first petitioner has already initiated the proceedings for the restitution of conjugal rights.

4. The object to the enactment is to give immediate relief by way of protection to the victim lady. That is the reason why an outer limit of 60 days' period is fixed for the conclusion of the proceedings. The other petitioners have been included for the purpose of getting a proper adjudication. Thus, this Court does not find any reason to interfere the same. However, except the first petitioner, the appearance of other petitioners before the Court below is dispensed with until and unless the same is required.
