RESPONDENT / RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to condone the delay of 490 days in filing the above Criminal revision petition against the Judgment dated 18.12.2015 made in C.A.No. 24 of 2014 on the file of the Additional District Court, Pudukottai confirming the Judgment dated 28.04.2014 made in S.T.C.No. 101 of 2011 on the file of the Judicial Magistrate, Pudukkottai PRAYER IN CRL RC(MD)No.
21017 of 2017:- to call for the records pertaining to the Judgment dated 18.12.2015 made in C.A.No.24 of 2014 on the file of the Additional District Court, Pudukkottai confirming the Judgment dated 28.04.2014 made in S.T.C.No.101 of 2011 on the file of the Judicial Magistrate, Pudukkottai and set aside the same by allowing this revision and to pass such other or further orders as this Hon'ble Court. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.R.JEGADEESWARAN, Advocate for the petitioner and of Mr.C.NAGAMUTHU, Advocate on behalf of the Respondent, the court made the following order:- On 11.01.2018, this Court passed the following order: "If the petitioner deposits a sum of Rs.25,000/- towards arrears amount of maintenance, to the credit of S.T.C.No.
101 of 2011, on the file of the learned Judicial Magistrate, Pudukkottai, within a period of four weeks from the date of receipt of a copy of this order, this Court would consider the relief of the petitioner to condone the delay of 490 days in filing the Criminal Revision Case. https://hcservices.ecourts.gov.
2. Registry is directed to post the matter after four weeks."
2. Today, the learned counsel for the petitioner has filed a memo stating that the order dated 11.01.2018 has been complied with and the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) has been deposited to the credit of S.T.C.No.101 of 2011 before the learned Judicial Magistrate, Pudukkottai, on 20.02.2018. The respondent will be now entitled to withdraw the amount.
3. In view of the above, this application is allowed and the delay of 490 days in filing Crl.R.C.(MD)SR.No.21017 of 2017 is condoned.
4. Registry is directed to number the revision, if the same is, otherwise, in order.
