ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 506(ii) IPC and Section 4 of Tamilnadu Prohibition of Women Harassment Act in C.C.No.365 of 2009 on the file of the learned Judicial Magistrate, Srivaikundram, seeks anticipatory bail.

2. It is submitted by the learned counsel for the petitioner that Non Bailable Warrant was issued against the petitioner by the learned Judicial Magistrate, Srivaikundram, on 12.02.2012 and the sme is pending. The police is not able to execute warrant till date.

3. It is represented by the learned Government Advocate (Crl.side) that there are two accused in this case and the first accused was arrested on 24.02.2015 and the petitioner is arrayed as the second accused.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State.

5. Considering the fact that non bailable warrant was issued against the petitioner for his absence, there shall be a direction, directing the petitioner to surrender before the learned Judicial Magistrate, Srivaikundram, within a period of two weeks from the date of receipt of copy of this order and to file a petition for bail and the learned Judicial Magistrate, Srivaikundram, is directed to consider the said petition and pass orders on merits in accordance with law on the same day.
