ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 498(A), 506 (i) I.P.C. and Section 4 of Dowry Prohibition Act in C.C.No.52 of 2015 on the file of the learned Judicial Magistrate, Aruppukkottai, seeks anticipatory bail.

2. It is submitted by the learned counsel for the petitioner that the petitioner was granted anticipatory bail in Crl.O.P.No.22109 of 2013 dated 05.12.2013 and after completion of investigation, the respondent police have filed charge sheet and the same was taken on file in C.C.No.52 of 2015 and due to the absence of the petitioner, Non Bailable Warrant was issued against the petitioner by the learned Judicial Magistrate, Aruppukkottai.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State.

4. Considering the fact that non bailable warrant was issued against the petitioner for his absence, there shall be a direction, directing the petitioner to surrender before the learned Judicial Magistrate, Aruppukkottai, within a period of two weeks from the date of receipt of copy of this order and to file a petition for recalling the warrant under Section 70(2) Cr.P.C. and the learned Judicial Magistrate,Aruppukkottai, is directed to consider the said application and pass orders on merits in accordance with law on the same day. The learned Magistrate is empowered to obtain fresh bonds https://hcservices.ecourts.gov.in/hcservices/

from the petitioner at the time of considering the application under Section 70(2) Cr.P.C.
