Heard the learned counsel on either side.

2.The rival parties have filed an appeal before the second respondent. The petitioner wants the said appeal to be disposed of after proper survey is conducted and not before that. The petitioner claims that he has submitted the necessary application and also paid the necessary charges. The petitioner is also permitted to submit a formal request in this regard to the second respondent. The second respondent shall consider the petitioner's request for conducting survey before passing final order. This writ petition is disposed of accordingly.
