O R D E R
This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate, Aranthangi, Pudukkottai to complete the trial and dispose of the case in C.C.No.55 of 2022 within the time stipulated by this Court.
2.According to the petitioner, he is the defacto complainant in this case and based on her complaint, an FIR in Crime No.180 of 2021 was registered for the offence under Sections 147, 148, 294(b), 342, 506(ii), 379, 420 and 498(A) of IPC and Section 4 of TNPHW Act, 2022 and thereafter, charge sheet has been filed and the same was taken on file in C.C.No.55 of 2022, which is pending for the past four years. Therefore, this petition has been filed.
3.The learned Additional Public Prosecutor appearing for the
respondent police would submit that in this case, the FIR has been registered in the year 2021 and charge sheet has been filed and the same was taken on file in the year 2022 and there are totally ten witnesses in this case and already witnesses L.W.1 to L.W.3 were examined and the case is now posted for examination of witnesses L.W.4 to L.W.6. He would further submit that the respondent police will co-operate for speedy disposal of the case and they will produce the witnesses without any delay as directed by the trial Court.
4.Though the FIR has been registered in the year 2021 and charge sheet has been filed and the same was taken on file in the year 2022, the case is still pending. However, already witnesses L.W.1 to L.W.3 were examined and the case is now posted for examination of witnesses L.W.4 to L.W.6. Therefore in view of the same, it is appropriate to direct the trial Court to expedite and complete the trial.
5.Accordingly, the trial Court is directed to complete the trial in C.C.No.55 of 2022 and dispose of the case as early as possible without granting any long adjournments.
6.With the above direction, this Criminal Original Petition is disposed of.
