25.In these writ petitions, permission letters have already been sent to the respective District Collectors, which were not processed till the disposal of these writ petitions. Hence, these category of cases are covered in the batch.

26.Heard both sides.

27.The information and communication have become life line on the earth. The gadgets have become inevitable appendages of the human body.

28.Nothing moves without signal. Sometimes movements are frozen as like that one happened in the recent past elsewhere in the world. The Kerala High Court and Supreme Court have even declared that access to Internet is a fundamental right. So, demand in their field grows in a rocket speed. But the infrastructure is at the snails feet. The gap is widening. This batch of cases will stand in testimony that demand can never be met. But at the same time, the process of installation, operation and maintenance of cellphone towers in a country, which is governed by a Rule of law, has to necessarily undergo in strict scrutiny and compliance of rules and regulations. Except the age old Indian Telegraph Act and the subsequent Government Orders and Letters, no other Law or Rule is available governing this field for establishing the over-ground installation.

29.In the background of the above situation, the grievance of the petitioner and the stand of the State Government must be addressed.

30.As I mentioned earlier, in all the cases the prayer or relief are very simple, but the problems are many folded. It is the case of the petitioner that permission by the respective District Collectors is deemed to have been granted as per Rule 10

(3) of the Indian Telegraph Right of Way Rules, 2016 and the said rule runs like this:-

(3) The appropriate authority shall, within a period not exceeding sixty days from the date of application made under Rule 9- (a) grant permission on such conditions including, but not limited to, the time, mode of execution, measures to mitigate public inconvenience or enhance public safety or structural safety and payment of restoration charge or compensation, subject to the provisions of the Act and these Rules; or (b) reject the application for reasons to be 17/24

recorded in writing;

provided that no application shall be rejected unless the applicant licensee has been given an opportunity of being heard on the reason for such rejection; Provided further that the permission shall be deemed to have been granted if the appropriate authority fails to either grant permission under clause (a) or reject the application under clause (b) and the same shall be communicated in writing to the applicant not later than five working days after permission is deemed to have been granted.

31.As per this rule, according to the petitioner, it has to be taken that the permission deemed to have been granted by the respective District Collectors.

As such, since they are experiencing or expecting trouble from some of the villagers in that area, they are entitled for police protection. The petitioner has also produced a number of orders that have been passed by this Court in the recent past.

32.Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor would submit that this provision will not come to the aid of the petitioner, as held in W.P.No.7544 of 2017 and 15144 of 2019 by the Hon'ble Division Bench of this Court dated 22.08.2019. But the learned counsel for the petitioner would submit that the rules framed by the Central Government in the aforesaid Indian Telegraph Right of Way Rules, 2016 was considered by the Hon'ble Division Bench in the aforesaid judgment. The learned Single Judge of this Court in W.P(MD) No.12971 of 2020, dated 16.10.2020, has taken into account this Rule and has accorded police protection. 33.It is the further submission of Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor that this Rule will not apply to the private buildings, but only the guidelines given in G.O(Ms) No.

2, Information Technology Department, dated 01.04.2002, hold the feet and unless these guidelines are being strictly complied by getting proper permission from the respective District Collectors, they are not entitled to get police protection for mere asking. 34.In the light of the rival submissions, the question, which arises for consideration is whether the petitioner is entitled for police protection as prayed for in all these petitions. 35.As rightly pointed out by the learned Additional Public Prosecutor the right is not automatic at the mere asking. They have to comply the requirements that have been set out in the Government Orders and the clarificatory letters issued in this regard. Hence, we will shortly survive the Government Orders and clarificatory letters.

For that purpose, we can straight away take the guidelines from the judgment of the Hon'ble Division Bench in W.P No.

2017 and 15144 of 2019 and the issue in that case was whether it is mandatory on the part of the cell phone operator to take prior permission from the authorities concerned?. This was the issue in earlier writ petition in W.P(MD) No.22190 of 2017, in which the Hon'ble Division Bench extracted the relevant Government Orders in this regard.

36.The first Government Order is G.O(MS) No.2, Information Technology Department dated 01.04.2002. This is the phase and ground Government Order. It is specifically applicable only to Government Offices and buildings. Later, G.O.Ms.No.302, Housing and Urban Development Department, dated 12.12.2012 has been issued making clarification to the effect that G.O.Ms.No.2, Information Technology Department, dated 01.04.2002, will be made applicable to the private buildings and lands also. Later, G.O.Ms.No.177, Municipal Administration and Water Supply Department, dated 17.12.2002, was also passed in respect of establishment of cell phone towers in heritage town areas. It has been mentioned that exemption will be made applicable subject to the height restrictions in the heritage towns in respect of the Madurai Corporation Area.

Later, a clarificatory Letter No.5742-C3-2008-6, dated 26.03.2009 has been issued stating that Corporation, Municipality and Local Bodies need not insist upon duty permission from the cell phone companies for the purpose of erecting BTS Towers. So, it is ordered by the Hon'ble Division Bench that permission has been obtained from the Authority under G.O.Ms.No.177, Municipal Administration and Water Supply Department, dated 17.12.2002, in which G.O.Ms.No.2, Information Technology Department dated 01.04.2021 is also relied. 37.On 01.06.2013, the Department of Telecommunication has issued guidelines for issuance of clearance for installation of mobile towers and the Hon'ble Division Bench of this Court has also extracted the entire guidelines in its order in W.P.Nos.7544 of 2017 and 15144 of 2019. Subsequently, on 01.08.

2013, the Department of Telecommunication has also issued Advisory Guidelines to the State Government for the purpose of issuing clearance for installation of mobile towers, which are extracted in paragraph No.12 of the judgment cited supra. The additional guidelines issued on 01.08.2013 are also extracted in paragraph No.13. Since all these guidelines have been extensively extracted in the aforesaid judgment, the same need not be repeated once again in this order. Later, as I mentioned earlier, Clauses 9 and 10 of the notification dated 15.11.2016 issued by the Government of India, Ministry of Communication, which is also called as Indian Telegraph Right of Way Rules, 2016, have been extracted in the said judgment. 38.A revised guideline was issued vide G.O.Ms.No.1, Information Technology(B4) Department, dated 21.02.

2018, wherein in paragraph No.

mobile towers under or upon the immovable property vested in or under the control or management of any appropriate authority, which means that the above said Indian Telegraph Right of Way Rules, 2016 will not apply to private land and buildings. So, the Hon'ble Division Bench of this Court has observed that the guidelines in G.O.Ms.No.2, Information Technology Department, dated 01.04.2002, will continue to apply for the installation of mobile towers in private buildings. According to the Hon'ble Division Bench, only the guidelines in G.O.Ms.No.2, Information Technology Department, dated 01.04.2002, holds the feet. The petitioner is bound to get proper permission from the respective authorities concerned, before erecting the cellphone towers in the private buildings. 39.

Now, as I mentioned earlier, the main argument on the side of the petitioner is the deeming permission clause in Rule 10(3) of the aforesaid Indian Telegraph Right of Way Rules, 2016. Since even after expiry of sixty days mentioned in the Rule, the respective District Collectors have not passed any orders either rejecting or permitting their request. So, automatically the permission must be taken to have been granted. But, D.O.Letter No.132515/IT (B4)/2019, dated 26.08.2019, had made the position very clear and also answering the arguments advanced by the learned counsel for the petitioner and the said letter runs like this:- D.O.Letter No.132515/IT (B4)/2019, dated 26.08.2019 Sub: Information Technology Department -Right of Way permission for laying Optical Fibre Cable (OFC) and Cellphone Towers- Further action requested - Regarding.

G.O.Ms.No.1, IT Department, dated 21.02.2018. ------- I am to invite your attention to the reference 3rd cited, wherein, orders have been issued, among other things, directing The District Collectors in respect of all Districts and the Commissioner for Greater Chennai Corporation in respect of Chennai be designated as the Nodal Officers for the respective jurisdictions and authorized to issue Right of Way (RoW) permissions for overground Telecom Infrastructure (Towers) and underground Telecom Infrastructure (OFC) in respect of all areas in the Districts (including Highways, Public Works Department, Forest etc.,) under the provisions of Indian Telegraph Right of Way Rules, 2016.

The existing guidelines as per G.O.(Ms) No.2, Information Technology Department dated 01.04.2002, for installation of Overground Telecom Infrastructure (Towers) in private Buildings, be continued since these are not covered by the Indian Telegraph Right of Way Rules, 2016.

2.In view of the above, I am to request you to abide by the instructions issued in G.O.(Ms) No.1, IT Department, dated 21.02.2018 for grant of Right of Way permission for laying OFC and for erection of cellphone towers. I am also to request you to send a monthly status report on Right of Way (RoW) permissions to Government in the template attached herewith.

40.Reading of the above said Government Letter, clearly shows that the Indian Telegraph Right of Way Rules, 2016 does not apply to the private buildings. So, G.O.Ms.No.2, Information Technology Department, dated 01.04.2002 must be strictly complied with. This letter clarifies the position as that one mentioned in G.O.Ms.No.1, dated 21.02.2012. The argument on the side of the petitioners is that Indian Telegraph Right of Way Rules, 2016 will apply to private building and lands also and as per rule 10(3) of the Indian Telegraph Right of Way Rules, 2016, permission deemed to have been granted, cannot be accepted. Unfortunately, it appears that G.O.Ms.No.1, dated 21.01.2021 was not brought to the notice of this Court, while passing order in W.P(MD) No.12971 of 2019. So, the petitioner cannot be taken advantage of the order passed in the aforesaid writ petition. It has been fairly admitted by the learned Additional Public Prosecutor that it was not properly brought to the notice of this Court at that time.

41.So, the discussion made above makes the position very clear to that effect that the petitioner should obtain permission from the respective District Collectors for the purpose of installing the mobile towers in the respective areas as mentioned in their petitions. Since it is a duty of the respective District Collector to process the petition with promptness and the result ought to have been informed to the petitioner, keeping the petition pending for months together may not be proper in the interest of the company as mentioned earlier.

42.In view of the above, these Writ Petitions are disposed of with the following directions:- (i) The third respondent/District Collector in W.P.(MD) Nos.7715, 7720, 7722, 7733, 7734, 7750, 8034, 8726, 8728, 8729, 8732, 8733, 8734, 8735, 8737, 8739, 8740, 8741, 8743 and 8745 of 2021 and first respondent/District Collector in W.P.(MD)Nos.4714, 4720 and 4723 of 2021 are directed to process the applications dated 13.11.2020, 10.12.2020, 21.02.2020, 04.11.2020, 10.04.2020, 21/24

09.01.2020, 28.01.2021, 29.01.2021, 04.11.2020, 01.12.2020, 01.12.2020, 10.12.2020, 05.03.2021, 18.11.2020, 27.02.2020, 01.12.2020, 23.03.2021, 05.01.2021 and 05.01.2021 respectively submitted by the petitioners within a month from the date of receipt of a copy of this order strictly in accordance with the guidelines issued in the aforesaid Government orders and letters etc. (ii) The result of the application must be intimated to the petitioner within a week thereafter.

(iii) Depending upon the out come of the permission applications, the petitioner is at liberty to make proper representation for taking police protection, if any necessity arises mentioning the facts and circumstances and necessity. (iv) If such request or representation is made by the petitioners, the respondent police is hereby directed to consider the same on merits and give police protection, if permission is granted by the respective District Collectors for installing mobile phone towers in the respective areas as mentioned in these petitions, immediately.

43.With these directions, these Writ Petitions are disposed of. No costs.
