O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to disburse the principal compensation amount payable under the award in L.A.O.P.No.19 of 2000, dated 05.12.2001, to pay statutory interest for the period of delay and to pass appropriate orders with respect to the remaining extent of 44 cents of land, either by restoration or by payment of compensation at the prevailing market value.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that though the award in L.A.O.P.No.19 of 2000 was passed on 05.12.2001 awarding Page No. 2 of 5

compensation at Rs.225/- per cent, the principal compensation amount has not been paid till date and only the court fee interest amount of Rs. 36,180/- was disbursed. The amount has not been deposited before the Court.

4. The learned Special Government Pleader appearing for the respondents, on instructions, would submit that the amount has been deposited in the Court.

5. In response, the learned counsel for the petitioner would submit that the amount was deposited in the State Treasury and not before the Court and the respondents have not taken steps to pay the said amount to the petitioner.

6. It is needless to mention that the said amount is payable to the petitioner herein. If the amount has been deposited in the Treasury, the respondents shall take necessary steps, on verification of the relevant documents, to transfer the amount to the petitioner's bank account as expeditiously as possible. If the amount has already been deposited before the Court, the concerned authorities shall move appropriate application Page No. 3 of 5

before the said Court so that the amount may be disbursed to the petitioner.

7. With the above observations, this Writ Petition is disposed of. No costs.
