Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, by calling for the records relating to the impugned order C.No.35/PKM PS/2025 dated 20.12.2025 on the file of the 3rd respondent and quash the same as illegal and consequently direct the Respondents No.2 to 4 to grant permission to conduct public meeting to Commemorate Thanthai Periyar's Death Anniversary for the Social Justice at 06.00 p.m., to 09.30 p.m., on 13.02.2026 or any other date with the scheduled place near KSK Canteen, Vadakari, Periyakulam, Theni District.

ORDER

This writ petition is filed for Writ of Certiorarified Mandamus to call for the records relating to the impugned order C.No.35/PKM PS/2025 dated 20.12.2025 on the file of the 3rd respondent and quash the same as illegal and consequently direct the Respondents No.2 to 4 to grant permission to conduct public meeting to Commemorate Thanthai Periyar's 2/5

Death Anniversary for the Social Justice at 06.00 p.m., to 09.30 p.m., on 13.02.2026 or any other date with the scheduled place near KSK Canteen, Vadakari, Periyakulam, Theni District.

2. The learned Government Advocate (Crl. Side) submitted that permission was rejected on the ground of law and order issues, as two FIRs are pending against the petitioner. It was further alleged that the petitioner may speak beyond the proposed subject matter, which could lead to communal tension and adversely affect public peace and the rights of others.

3. Considering the facts and circumstances of the case, this Court is of the opinion that appropriate and stringent conditions can be imposed for conducting the public meeting. Therefore, the impugned order dated 20.12.2025 is quashed. The petitioner is directed to submit a fresh representation to the respondents, and upon such submission, the same shall be considered on its own merits. The respondents are at liberty to impose strict conditions, including limiting the number of participants and conducting the meeting without the use of sound amplification systems and not to speak any content which would cause communal tension. 3/5

4. With the above directions, this Writ Petition (Criminal) is disposed of.
