O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in No. 1052/Vu.tha.2/2025 dated 17.10.2025 and direct the respondents 1 and 2 to grant ordinary leave without escort for the period of 21 days to the petitioner namely Geetha Bai, W/o. Narsasimha Bai, PID No. 562750 who is languishing in the Special Prison for Women , Madurai.

It is the case of the petitioner that she was convicted by the learned II Additional Sessions Judge for CBI Cases, Madurai in C.C.No.7 of 2021 and sentenced to undergo four years imprisonment for the offence under Section 13(2) r/w.13(1)(e) of PC Act Cases. Aggrieved over the same, the convict has filed an appeal before this Court in Crl.A(MD) No.79 of 2016 and the same was dismissed. The petitioner is in jail for more than two years. The petitioner submitted an application seeking ordinary leave for a period of 21
days, however the same was rejected on the ground that the petitioner is facing trial in one more case in C.C.No.9 of 20120 Now the CC.No.9 of 2012 ended in conviction by judgment dated 24.12.2025 for the offences under Sections 120(B) r/w.420 of IPC. As of now no case is pending for trial as against the petitioner.
3. In view of the above, the order of the first respondent dated 17.10.2025 is set aside and the convict is granted 21 days ordinary leave witout police escort. However, the convict is directed to comply with the usual conditions imposed by the jail authorities and she should also report before the fourth respondent police daily at 05.30 p.m. till the completion of leave period. He shall duly comply with the conditions and return to the prison on expiry of the leave period.
