ORDER

This Writ Petition is filed seeking a Writ of Mandamus, directing the respondents 1 and 2 to survey and demarcate the petitioner's land comprised in Survey No.94/4, to an extent of 0.28.50 Hectare and 0.70 Acre, situated at Thevarmalai Village, Kadavur Taluk, Karur District, forthwith with police protection, if necessary.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property and is in peaceful possession and enjoyment of the same. It is further submitted that the petitioner made an application dated 31.10.2025 before the competent authority, seeking survey and

fixation of boundaries in respect of the said property. Pursuant to the said application, on 09.01.2026, the revenue officials visited the petitioner's land for the purpose of conducting survey and measurement. At that time, the fourth respondent herein unlawfully trespassed into the petitioner's property and obstructed the officials from carrying out the survey. Due to such obstruction caused by the fourth respondent, the survey could not be completed. Despite the petitioner's request, no further effective steps have been taken by the authorities. Hence, the petitioner has been constrained to file the present Writ Petition seeking appropriate directions to enable the authorities to conduct the survey and fix the boundaries with adequate police protection.

4. The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

5. Recording the aforesaid submission, this Court directs the respondents 1 and 2 to consider the petitioner's application dated 31.10.2025 and demarcate the

subject property, after considering the claims of the petitioner, the fourth respondent and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. Needless to state, the revenue officials are at liberty to seek necessary assistance from the third respondent police, if police protection is required at the time of conducting the survey and fixing the boundaries of the subject property. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
