Respondent in both WPs COMMON PRAYER: Writ Petitions are filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus to call for the records relating to the impugned order issued by the respondent in Rc.A2/15107/2019 dated 18.09.2019 and to quash the same and consequently directing the respondent to reinstate the petitioners into service forthwith, with all consequential benefits.
For Petitioner : Mr.S.Venkatesan For Respondent : Mr.A.Kannan Additional Government Pleader (in both WPs) C O M M O N O R D E R These writ petitions are filed as against the order of suspension issued as against the petitioners by the respondent in Rc.A2/15107/2019 dated 18.09.2019.
2.These petitioners who were working as Firka Surveyor and Head Surveyor have been placed under suspension by the respondent, on the grave charges contemplated against them. Though, these petitioners have been suspended on 18.09.2019, the respondent has not conclude the enquiry. Therefore, this Court has also entertained these writ petitions and granted an interim order of stay.
3.Now it is reported by the learned counsel for the petitioners as well as the respondent that the charge memo has https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P(MD)Nos.3969 & 3988 of 2020 been issued and the enquiry officer has also been appointed. 4.Since charge memo has already been issued and enquiry has also been commenced, without expressing anything on the claim of the petitioners, this Court is inclined to dispose of these writ petitions , with a direction to the petitioners as well as the respondent to co-operate before the enquiry officer, to conclude the enquiry, within a period of two months from the date of receipt of a copy of this order. The enquiry officer shall also conduct the enquiry and process the same on day today basis and conclude the enquiry within a period of two months from the date of receipt of a copy of this order.
5.With the above directions, these writ petitions are disposed of. No Costs. Consequently, connected Miscellaneous Petitions are closed and the orders impugned in these writ petitions are restored.
