PRAYER: Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 to direct the second respondent to provide adequate police protection to the life and limb of the petitioner within the time stipulated by this Court on the basis of the petitioner's representation dated 31.12.2024. O R D E R
This petition has been filed by the petitioner to direct the second respondent to provide adequate police protection to the petitioner within the stipulated time fixed by this Court, based on her representation, dated 31.12.2024.
2. The learned counsel for the petitioner would submit that there are some disputes between the petitioner and the third respondent, claiming that she is the second wife of the son of the petitioner, thereby, all the private respondents together prevented the petitioner to enter into her house and also caused life threat. Thereby, she sent a representation, dated 31.12.2024 and the same has not been considered by the police. Page No. 2 of 5
3. The learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2 would submit that based on the complaint given by the petitioner, they conducted enquiry and closed the complaint. Since the third respondent is claiming that she is the second wife of the son of the petitioner, there is a dispute between the parties. Since already the representation filed by the petitioner was considered and closed, the present petition is liable to be dismissed.
4. This Court heard both sides and perused the records.
5. Considering the limited scope of the prayer sought for in this petition, this Court, even without issuing notice to the private respondents/respondents 3 to 16, is inclined to dispose of this petition. Since already the representation of the petitioner was considered by the respondents police and the same was also closed, this Court disposed of this petition with a liberty to the petitioner to approach the second respondent police, if any life threat made by anybody and if any complaint received by the second respondent police, they shall consider the same and take appropriate action in accordance with law. 6. With the above said observations, this Criminal Original Petition is closed.
