RESPONDENT / RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed on the petitioner in Crl.M.P(MD) NO.3748 of 2019 in Crl.A.(MD) NO.173 of 2019 on 24/04/2019 in so far as it relates to directing the petitioner to appear before the learned Judicial Magistrate Court, NO.II, Nagercoil on the first working day of every month at 10.30 a.m. Pending appeal and thus render justice.

Prayer in CRL MP(MD). 3748/ 2019 :

To suspend the sentence of Imprisonment imposed on the petitioners/Appellants by the Learned Principal Sessions Judge, Kanyakumari District at Nagercoil in S.C.No.196/2016 dated 02/04/2019 and enlarge the petitioners/appellants on bail pending disposal of the above Crl.A.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.JEEVAGAN, Advocate for the petitioner and of M/S. V.NEELAKANDAN, Additional Public Prosecutor, on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the conditions imposed on the petitioner in Crl.M.P(MD)No.3748 of 2019 in Crl.A(MD)No.173 of 2019, dated 24.04.2020. 2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this Court in Crl.M.P(MD)No.3748 of 2019 in Crl.A(MD)No.173 of 2019, dated 24.04.2020 regularly and he prayed for relaxation of the said condition.

3.The learned Additional Public Prosecutor has no strong objection to relax the condition.

4.Taking into consideration of the submissions made by both the learned counsel, the condition imposed by this Court in Crl.M.P(MD) No.3748 of 2019 in Crl.A(MD)No.173 of 2019, dated 24.04.2020 is relaxed in toto.
