ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 118(1), 109(1) of BNS Act, 2023, in Crime No.20 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that, while the petitioner and the other accused persons were consuming alcohol in a bar, they assaulted a cat roaming there. When the defacto complainant questioned the same, the accused persons abused him in filthy language. Thereafter, the first accused assaulted the defacto complainant on the head with a reaper stick, causing bleeding injuries on his head and right index finger. One Sellapandi, a co-worker who intervened, also sustained an abrasion injury. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory 2/5

bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent Police submitted that the cat was brutally attacked by the petitioner. When the same was questioned by the defacto complainant, the accused persons assaulted him and caused injuries. He further submitted that three previous cases are pending against the petitioner. Therefore, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the heinous nature of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 11.02.2026 jbr 3/5
