ORDER
This Writ Petition has been filed seeking a direction to the second respondent herein to accept the Form VII submitted by the petitioner, dated 18.01.2025, for the period 2025-2028 of the Zamin Kollankondan Nadar Uravinmurai (Reg. No.60/2004), Zamin Kollankondan, Rajapalayam Via, Rajapalayam Taluk, Virudhunagar District.
2. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel for the petitioner submits that Zamin Kollankondan Nadar Uravinmurai is a society registered under the provisions of the Tamil Nadu Societies Registration Act, 1975. As per the society's bye-laws, a resolution was passed on 18.12.2024 with the agenda to notify the election. Pursuant to the same, a notification was issued on 21.12.2024. A general body meeting was convened on 12.01.2025, wherein 52 members were present and an election was conducted, resulting in the change of the Executive Committee. The new office bearers assumed office on 23.01.2025 for the triennium period 2025-2028. Accordingly,
Form VII was submitted to the second respondent for necessary endorsement on 18.01.2025. Despite the same, the second respondent has delayed the issue, which leads to affect the administration of the society. Hence, the present Writ Petition.
4. The learned Government Advocate appearing for the respondents submits that the Form-VII submitted by the petitioner was returned due to certain defects. If the petitioner resubmits the Form after addressing the defects pointed out by the second respondent, it will be considered in accordance with law, within a time frame to be fixed by this Court.
5. Recording the above submissions, this Writ Petition is disposed of, with a direction to the petitioner to submit the Form VII after rectifying the defects pointed out by the second respondent, within a period of one week from the date of receipt of a copy of this order. Upon receipt of such rectification, the second respondent shall consider it on merits and pass appropriate orders in accordance with law, within three weeks thereafter.
