RESPONDENT/ RESPONDENT/ COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the condition imposed by this Honourable Court by its order dated 19.04.2017 in Crl.M.P.NO.579 of 2017 in Crl.A.(MD).No.17 of 2017 on the file of this Honourable Court.

Prayer in CRL MP(MD). 579/ 2017 in Crl.A.(MD).No.17 of 2017: To SUSPEND THE SENTENCE imposed on the Petitioner by the Learned I Additional District and Sessions Court (PCR) Thanjavur in Special S.C. NO. 73 of 2013 dated 05.12.2016 and enlarge the Petitioner on bail pending disposal of the above Criminal Appeal. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.N.ANANTHAPADMANABHAN, Advocate for the petitioner and of M/S.T.MOHAN, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- The learned counsel for the petitioner is present. 2.A report received from the learned I Additional District & Sessions Judge (PCR), Thanjavur, dated 07.11.2017, reveals the fact that the petitioner complied with the condition from the month of May 2017 to November 2017. The Criminal Appeal preferred by the petitioner is still pending.

3.The learned counsel for the petitioner submitted that it is very difficult for the petitioner to travel from Cuddalore to Thanjavur for complying with the condition and he is also aged about 80 years old. Hence, the petitioner prays to modify the condition as appear before Principal District and Sessions Court, Cuddalore instead of I Additional District and Sessions Court (PCR), Thanjavur.

4.Considering the facts and circumstances of the case and considering the nature of charges, the earlier condition is modified to that effect and the petitioner is directed to appear before the Principal District and Sessions Court, Cuddalore on the first working day of every English Calender month at 10.30 a.m. until disposal of the Criminal Appeal. This petition is ordered accordingly.
