J U D G M E N T
[Judgment of the Court was made by DR.G.JAYACHANDRAN, J.] This writ appeal is filed by the Co-operative Society challenging the order dated 17.11.2025, passed by the learned Single Judge in W.P.(MD) No.30283 of 2025, directing the appellant / Co-operative Society to pay the retirement benefits to the first respondent / writ petitioner along with 6% interest from the date of his superannuation till the date of payment, in three equal monthly installments starting from January, 2026.
2. It is a pathetic case that a former employee of the appellant / Co-operative Society, who retired from service in the year 2014, is deprived of
his retirement benefits for the past twelve years. Citing the financial crisis of the appellant / Co-operative Society, the retirement benefits have not been paid to the first respondent, which has prompted him to approach this Court for redressal by filing the writ petition. This Court, after taking into consideration the facts of the case and the admission made by the appellant / Co-operative Society in their counter affidavit regarding the retirement benefits due and payable to the first respondent, has passed the following order: "When the matter was taken up for hearing, the counter affidavit filed by the second respondent, wherein there is an admission that the petitioner is entitled to retirement benefits of Rs.5,68,579/- and that he was also aware that the same would be disbursed in installments.
2. In view of the admitted facts, a direction is issued to the respondents to disburse the terminal benefits of Rs.5,68,579/-, by also calculating the interest at the rate of 6% per annum from the date of superannuation till the date of payment. The said payment shall be made in three equal monthly installments, starting from January 2026.
3. With the above directions, this Writ Petition is disposed of. No Costs."

In spite of the direction issued by the learned Single Judge in the writ petition to the appellant / Co-operative Society to pay the retirement benefits due with a nominal rate of interest i.e., 6% per annum to the first respondent, the Administrator of the Co-operative Society has filed this writ appeal stating that awarding 6% interest for the belated payment of the retirement benefits is contrary to law and citing the financial crisis, the appellant / Co-operative Society seeks indulgence of this Court to interfere with the order passed by the learned Single Judge.
4. To say least, this writ appeal is preferred without any sense of human consideration. An employee under the appellant / Co-operative Society is deprived of his retirement benefits for the past 12 years on the sole reason that the appellant / Co-operative Society is in financial crisis. The cause of the financial crisis is the mis-management of the Co-operative Society. For the said purpose, the employee, who served for the Co-operative Society, cannot be penalized. Hence, we are not inclined to entertain this writ appeal.
5. Accordingly, this writ appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] [K.K.R.K., J.] 11.02.2026 NCC :
