Muhamad Igbal v. The Inspector Of Police
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Thursday, the Nineteenth day of March Two Thousand Fifteen PRESENT The Hon`ble Mr Justice P.N.PRAKASH CRL OP(MD) No.3885 of 2015 MUHAMAD IGBAL ... PETITIONER / SOLE ACCUSED Vs THE STATE REP.BY THE INSPECTOR OF POLICE, DINDIGUL TOWN SOUTH POLICE STATION, DINDIGUL.
CRIME NO.95/2015.
... RESPONDENT / COMPLAINANT For Petitioner : M/S.S.M.A.JINNAH Advocate For Respondent : M/S.A.P.BALASUBRAMANIAN, Govt. Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 468 and 471 IPC r/w 12(1)(b) of the Passport Act, 1967 in Crime No.95 of 2015 on the file of the respondent police, seeks anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.
3. This case has been registered on the complaint dated 24.01.2015 given by the Regional Passport Officer, Madurai. The case of the prosecution is that this petitioner applied for Passport and along with application, he submitted a transfer certificate dated 29.06.1992, issued by the Government High School, Ramanathapuram, Kovilur, Vedachandur, Theni District, which was found to be a forged document.

4. Learned counsel for the petitioner submitted that the petitioner was issued the said transfer certificate by the School authorities and he came to know that the same was forged only after receiving the show cause notice from the Passport authorities. Thereafter, the petitioner approached the School, namely, Nagaravai High School, Mettuppatti, Dindigul, in which he studied and obtained a fresh transfer certificate and submitted the same to the Passport authorities. Learned counsel for the petitioner also submitted that except for the change in the name of the school, the rest of the particulars in both the fake certificate and the original certificate are one and the same.
5. I am unable to persuade myself to agree with his argument, because, Police, during the course of investigation, have recorded statement from the Head Master of Government High School, Kovilur, who has stated that the impugned certificate was never issued by their school.
6. Under such circumstances, custodial interrogation of this petitioner is necessary to find out as to how the fake transfer certificate was fabricated and who all are involved in the manufacture and supply of such bogus certificates in the State.
7. Taking into consideration the serious nature of allegations against this petitioner, this Court is not inclined to grant anticipatory bail to him. Hence, the Criminal Original Petition is dismissed.
