[Order of the Court was made by K.KALYANASUNDARAM, J.] The prayer in this habeas corpus petition is to direct the respondents to secure the petitioner's daughter namely Jeyamathi, aged 17 years, produce her before this Court and hand over her custody to the petitioner.
2.It is the case of the petitioner that her daughter Jeyamathi the detenue is studying and on 19.02.2021 at about 08.30 am, she left to the college and thereafter she did not return home. Hence she lodged a complaint with the second respondent on 19.02.2021 and a case was registered in Crime No.63 of 2021 for the offences under Section 366 (A) IPC. But no action was taken action on her complaint and hence, the petitioner has approached this Court. https://hcservices.ecourts.gov.in/hcservices/ 1/2
H.C.P(MD)No.342 of 2021 3.Mr.S.Chandrasekar, learned Additional Public Prosecutor appearing for the respondents made a mention before this Court that the detenue in this case has been secured and therefore, the matter is taken up for hearing today.
4.When the matter is taken up for hearing today, the detenue was produced by the respodent Police through video conferencing. On enquiry she would state that she is studying 1st year LLB., course at Ramanathapuram, she is not willing to go with her mother and she expressed her willingness to go to a Government Home at Ramanathapuram.
5.In view of the above statement of the detenue, the respondent Police are directed to send the detenue namely Jeyamathi, D/O.Jaganathan to Annai Sathya Home, Ramanathapuram. 6.With the above direction, this habeas corpus petition is disposed of.
