ORDER
This writ petition has been filed for a Mandamus seeking for a direction to the respondent to cancel the wrong entries and wrong classification in the revenue records, which were made during UDR Survey in respect of the Punja lands to the extent of 266.40 acres in old Survey Nos.1 to 31 situated in Sayalkudi Tank, Sayalkudi, Kadaladi Taluk, Ramanthapuram District and restore patta in the name of the original owner of the aforesaid land by considering the representations of the petitioner dated 27.12.2021 & 01.02.2022. within a time frame to be fixed by this Court. 2.It is the case of the petitioner that the entries have been made subsequent to the UDR survey for the aforementioned lands. He has given the representations on 27.12.2021 and 01.02.2022 to the official respondent for rectifying the mistake. Since the representations have not been considered till date, he has filed this writ petition.
3.Heard Mr.R.Gowrishankar, learned Counsel for the writ petitioner and Mr.D.Sasi Kumar, learned Additional Government Pleader, who accepts notice on behalf of the respondent. https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.[MD]No.3858 of 2022 4.The learned Additional Government Pleader appearing for the respondent would submit that enquiry in the petitioner's representations has already commenced and the next date of hearing is fixed on 10.03.2022.
5.Since the enquiry has already commenced, no prejudice would be caused to the respondent, if a direction is issued to the respondent to pass final orders on the petitioner's representations on merits and in accordance with law, after affording a fair hearing to the petitioner as well as rival claimants, if any, within a period of twelve (12) weeks form the date of receipt of a copy of this order.
6.Accordingly, this Court directs the respondent to pass final orders on the petitioner's representations dated 27.12.2021 & 01.02.2022 on merits and in accordance with law, after affording a fair hearing to the petitioner as well as rival claimants, if any, within a period of twelve (12) weeks form the date of receipt of a copy of this order.
7.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
