PRAYER: Criminal Miscellaneous Petition filed under Section 439(2) of Cr.P.C. praying to cancel the order of Anticipatory Bail granted to the respondent/accused in Crl.O.P(MD)No.15827 of 2021, dated 12.10.2021.

ORDER

This Criminal Miscellaneous Petition has been filed to cancel the anticipatory bail granted to the respondent/accused in Crl.O.P (MD)No.15821 of 2021, dated 12.10.2021.

2.The learned Government Advocate (Crl.side) appearing for the petitioner submitted that this Court by an order dated 12.10.2021 in Crl.O.P(MD)No.15821 of 2021 granted anticipatory bail to the respondent on condition that the respondent should appear before the CBCID, Counterfeit Currency Wing, Madurai at 10.00 a.m. until further orders for interrogation. But the respondent has not produced any surety and he did not report before the said police station. So, the anticipatory bail granted to the respondent must be cancelled.

Crl.M.P(MD)No.3059 of 2022 3.This Court granted anticipatory bail to the respondent only on condition that the respondent should produce the sureties, on receipt of the same, he can be released on bail. The anticipatory bail was granted on 12.10.2021 but till date, the accused/respondent has not surrendered and executed the surety. It is needless to say that the petitioner can proceed in accordance with law. 4.In view of the above, this Criminal Miscellaneous Petition is closed.
