Prayer in CRL OP(MD). 13435/ 2018 :

Petition filed under section 482 of Code of Criminal Procedure praying to withdraw the case in Crime No. 7 of 2016 from the file of 2nd respondent and transfer the same to the file of the 3rd respondent with direction to conduct further investigation in accordance with law within the period that may be stipulated by this Honourable Court.

ORDER

This Contempt Petition has been filed to punish the respondent for willful disobedience of the order passed by this Court in Crl.O.P.(MD).No.13435 of 2018 dated 05.11.2019, thereby, transferred the case in Crime No.7 of 2016 to the file of the third respondent from the file of the second respondent and directed the third respondent to complete the investigation and file a final report within a period of twelve (12) weeks from the date of receipt of the entire case records.

2. The learned Additional Public Prosecutor appearing for the respondent would submit that, as directed by this Court, the respondent completed the investigation and also prepared a final https://hcservices.ecourts.gov.in/hcservices/ 1/2

Cont.P.(MD).No.480 of 2022 report as early as on 26.03.2022 itself. However, the respondent could not able to file the same before the concerned Judicial Magistrate, since the said post is vacant.

3. Recording the said submission, this Contempt Petition is closed.
