Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the first respondent to take necessary steps to made entry in revenue records in respect of the property situated in S.No. 185/22, plot No.115 in Mappillaioorani Village, Thoothukudi Taluk, Thoothukudi District, with regards to the order of assignment of house site granted in favour of the petitioner vide proceedings in A2/10325/2007 (Vv.M.Assignment No.2/1417) dated 17.09.2007 and to issue chitta in the name of the petitioner by considering the petitioner's representation dated 20.11.2024 and within the time limit fixed by this Court.

ORDER

The petitioner seeks issuance of a Writ of Mandamus to direct the first respondent to take necessary steps to enter his name in the revenue records based on the assignment patta dated 17.09.2007 granted to the petitioner. The petitioner has made a representation to the respondents on 20.11.2024 and there has been no action taken thereon and hence, the petitioner has been constrained to file the instant writ petition.

2.Considering the limited scope of the relief sought for in the writ petition, with the consent of the learned counsel on either side, the writ petition is taken up for final disposal at the stage of admission itself. 3.The learned Additional Government Pleader appearing for the official respondents would submit that the second respondent will be the competent authority to pass orders on the petitioner's application to include his name in the revenue records. He would further submit that the petitioner would have to satisfy the second respondent regarding the entitlement of the petitioner, including the legality and validity of the assignment deed in which, the petitioner claims right. 2/4

4.In view of the above, this Writ Petition is disposed of, directing the second respondent to pass orders on the petitioner's representation dated 20.11.2024, on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
