PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to return the sale deed dated, 11.12.1995, registered as document No.3680/1995 on the file of the 2nd respondent, relates to the house property in Plot No. 48 in TWAD Board Colony, and comprised in S.No.140/3B in Tiruppalai Village, in Madurai District. The petitioner with a grievance that even after clearance of housing loan by the petitioner, the first respondent has not returned the sale deed has filed this writ petition. 2.This writ petition is filed in the year 2022. Even then, the first respondent has not responded to this writ petition. The second respondent has filed a counter affidavit stating that the document sought for by this petitioner is with the first respondent and they are not having any role in this writ petition. 3.Considering the limited prayer sought for by the petitioner, this writ petition is allowed. The first respondent is directed to return the document to the petitioner, in the event, if the petitioner has settled the entire loan amount.
