The petitioner is the father of Farhana, aged about 19 years. She has fallen in love with one Mathi / third respondent and has gone with him.
2. Alleging that his daughter had been kidnapped by the third respondent and his associates, the petitioner lodged a complaint before the respondent - Police on 24.01.2025 and the same has been registered in Crime No.37 of 2025 under "Woman Missing" caption.
3. The present habeas corpus petition is filed by the petitioner stating that his daughter had been forcibly taken by the third respondent and her whereabouts are not known.
4. The respondent - Police has secured the petitioner's daughter as well as the third respondent and produced them before this Court today. Hence, this habeas corpus petition is listed today under the additional list, after causing notice to the learned counsel for the petitioner.
5. The petitioner as well as his wife are present. The detenue along with the third respondent is present. On enquiry, the daughter of the petitioner states that she has gone with the third respondent willingly. She being a major, she has decided to marry him. She is not under the illegal custody of anybody.
6. Recording the same, this habeas corpus petition is dismissed, since this Court is satisfied that the daughter of the petitioner is not under the illegal custody of the third respondent.
