2. Nalla Durai @ Pandy ... Petitioners/Accused No.1 & 4 Vs State Rep.by The Inspector of Police, Thalayuthu Police Station, Tirunelveli.
Cr.No.227/2021.
... Respondent/Complainant For Petitioners : M/s.Kathirvelu, Senior Counsel for M/s.Prabhu.K, Advocate.
For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C.
PRAYER :- For Bail in Crime No.227 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/accused, who were arrested and remanded to judicial custody on 06.08.2012 and 15.07.2021 for the offence punishable under Sections 147,148,302,120(b),506(ii),109,212,114,149 and 34 of IPC in crime No.227 of 2021 on the file of the respondent police, seeks bail.
2. The learned Senior Counsel appearing for the petitioners would submit that so far prosecution has examined P.W. 1 to P.W.3, thereby eye witnesses have turned hostile. There are totally 18 accused in this case and some of the accused were granted bail. Further trial is also going on.
3. Heard both sides and perused the materials available on record including the First Information Report https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.3585 of 2023
4. This is the third application of bail. Further the first petitioner involved in 14 previous cases and the second petitioner involved in three previous cases. There was a communal clash between the petitioners group and the opposite group. Taking into consideration the fact that there is no change in circumstances of the case even after dismissal of the earlier petitions, this Court is not inclined to grant bail to the petitioners.
5. Hence the petition stands dismissed.
