Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the first respondent to conduct survey and demarcate the four boundaries of the petitioner's property situated in S.No. 748/14A and S.No.748/12B measuring to an extent of 7.23 cents situated at Nullivilai 'B' Village, Kalkulam Taluk, Eraniel, Kanyakumari District by considering his application vide payment of challan dated 20.12.2024 within the time fixed by this Court.

ORDER

When the writ petition is taken up for admission, the learned Additional Government Pleader appearing for the first respondent would submit that the survey is being conducted on 24.02.2025.

2.The petitioner has only sought for the relief of a direction to conduct survey.

3.Considering that the patta is standing in joint names and the first respondent had already fixed 24.02.2025 as the proposed date for conducting survey, the petitioner shall co-operate with the said survey and in the event of the first respondent apprehending any law and order situation, it may be open to the first respondent to approach the jurisdictional police station and seek for adequate police protection. The survey shall be conducted after putting the second respondent on advance notice.
