O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in No. RO/TRY/674/2025-CA dated 08.01.2026 and direct the first respondent to grant 40 days ordinary leave without police escort to the petitioner namely Rajesh, S/o. Thasaiyya, aged about 42 years , Life convict prisoner PID No.3610 confined at Central Prison, Trichy,

2. It is the case of the petitioner that he was convicted by the learned Principal Sessions Judge, Thanjavur in S.C. No.44 of 2007 on 14.03.2008 and sentenced to undergo capital punishment for death sentence for three counts under Section 302 of IPC ( 3 counts). Aggrieved over the same, he has filed an appeal before this Court in Crl.A(MD) No.155 of 2008 on 25.04.2008 and the death sentence imposed by the trial Court is modified to life imprisonment (3 counts). The petitioner is in jail for more than 17 years and

10 months. So far the convict has not filed application for leave and his family members have also neglected him. Therefore the friend of the petitioner submitted representation seeking 40 days ordinary leave for the convict, however it was rejected on the ground that the investigation officer has not supported the case of the petitioner and also he has submitted adverse report. However the Probation Officer certified that the conduct of the convict is good.

Accordingly, the order of the first respondent dated 08.01.2026 is set aside and the petitioner is granted 20 days ordinary leave without escort on condition the convict shall stay at Trichy and report before the Inspector of Police, K.K. Nagar Police Station, Trichy District daily at 10.30a.m., and 5.30 pm., till the completion of leave period. Further the convict is also directed to furnish his address to the second respondent about his stay in Trichy.
