ORDER : The Court made the following order :- 1/4

The petitioner, who was arrested and remanded to judicial custody on 10.08.2025 for the offences punishable under Sections 302 of IPC, in Crime No.136 of 2019 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner attacked the defacto complainant's brother using wooden log and he died on the way to hospital Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 10.08.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that earlier bail was granted and subsequently, cancelled on 10.09.2025 on the allegation that the petitioner attacked the defacto 2/4

complainant's wife using Aruval. The present bail application is filed by A1. Already he was accused in another case. Hence, he opposed to grant bail.

5. The petitioner was arrested on 10.08.2025, based on long incarceration, the petitioner claiming bail. But it is seen the matter was posted on 16.02.2026 before the trial Court and 18 witnesses are there out of which examination of 16 witnesses are over. The trial is on the verge of completion. Considering the same, this Court is not inclined to grant bail to the petitioner.
