ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent 1/3
police for the alleged offence punishable under Sections 25(1B)(a) of Arms Act, in Crime No.148 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 12.10.2023, when the respondent police conducted a vehicle check up, the petitioner herein are found in possession of country made barrel gun along with charcoal powder in a plastic cover. Hence, the case has been registered.
3. The learned counsel appearing for the petitioner submitted that it is a third anticipatory bail petition and the earlier two petitions filed by the petitioner were dismissed by this Court.
4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the the petitioner herein was found in possession of country made single barrel gun with charcoal powder in a plastic cover. Hence, strongly objected to grant anticipatory bail.
5. Considering the serious nature of offence committed by the petitioner and that there is no change of circumstances after dismissal of the earlier petitions, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
