PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to call for the records relating to the impugned charge sheet in CC.No.380 of 2023 on the file of the learned Judicial Magistrate, Paramakudi, Ramanathapuram District in Crime No.396 of 2020 dated 29.07.2020 on the file of the first Respondent and quash the same insofar as the petitioners are concerned.

This Criminal Original Petition had been filed seeking to quash the charge sheet in CC.No.380 of 2023 on the file of the learned Judicial Magistrate, Paramakudi, Ramanathapuram District. 2.Mr.K.Yarar Arafath, learned Counsel [Enrl.No.2579/2016, Mobile No.88830 76485], who filed Vakalat on behalf of the Petitioners/Accused 1 and 2, Mr.M.Veeranthiran, learned Government Advocate (Crl.side) appearing on behalf of the first Respondent and Mr.M.Arikaran, learned Counsel (Enrl.No.841/20181, Mobile No.96888 59471], who filed Vakalat on behalf of the Respondents 2 and 3 are present in Court. 3.The learned Counsel for the Petitioners submitted that the Petitioners are arrayed as Accused 1 and 2 in CC.No.380 of 2023 on the file of the learned Judicial Magistrate, Paramakudi, Ramanathapuram District. Pending trial, the Accused and the de-facto Complainant had arrived at an amicable settlement. A joint compromise memo had also been filed before this Court by the learned Counsel for the Petitioners and the learned 2/5
Counsel for the second Respondent/de-facto Complainant. 4.The learned Government Advocate (crl.side), on instructions from the first Respondent, submitted that the compromise arrived at between the parties are bona fide.
5.The first Respondent had also filed a status report, in which, it is stated that during the pendency of the trial proceedings, the accused and the de-facto Complainant had arrived at an amicable settlement. 6.In the light of the status report filed by the first Respondent, the joint compromise memo filed by the parties concerned is recorded. Accordingly, the Criminal Original Petition is allowed and the Charge Sheet in CC.No.380 of 2023 on the file of the learned Judicial Magistrate, Paramakudi, Ramanathapuram District is hereby quashed.
