ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 332, 307 and 379 of IPC., r/w Sections 36(A), 4, 21(5) of Mines and Mineral (Development and Resolution) Act 1957, in Crime No.20 of 2017 on the file of the respondent Police, seeks anticipatory bail.

2. The learned Additional Public Prosecutor appearing for the respondent, on instructions, would submit that the earlier anticipatory bail application and also the extension of time application moved by the petitioner were dismissed by this Court respectively on 09.02.2017 and 20.04.2017. The present application is filed as a second time seeking anticipatory bail on the same set of facts.

3. Pursuant to the order passed by this Court in Crl.O.P(MD). No.10048 of 2017 dated 02.08.2017, the petitioner has deposited a sum of Rs.1,000/- (Rupees One Thousand only) before the Legal Services Authority, attached to this Bench, on 04.08.2017 and the proof of payment in SR.No.2163 of 2017 dated 04.08.2017, is also filed before the Court.

4.Considering the facts and circumstances of the case, and also considering the fact that the petitioner has complied with the condition imposed by this Court, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the https://hcservices.ecourts.gov.in/hcservices/

event of arrest or on his appearance before the learned Judicial Magistrate No.II, Dindigul, Dindigul District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
