Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 406,420 and 506(i) r/w 120(b) IPC, in Crime NO. 6 of 2015 on the file of the respondent police, seek anticipatory bail.
2. This Court, vide order dated 24.03.2015, had passed the following order:- "Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side).
2.The respondent police is present and filed a status report in this case.
3.The de-facto complainant is an Army man and he has been royally cheated by the petitioners and others by showing the property of one Sudhamaniyammal. When the de-facto complainant approached Sudhamaniyammal, much to his surprise, Sudhamaniyammal replied that she has no intention of selling the property and thus these petitioners cheated the Army man to the tune of Rs.15 lakhs. https://hcservices.ecourts.gov.in/hcservices/
4. It is submitted by the learned Government Advocate (Crl. Side) that the petitioner in Crl.O.P.(MD) No. 4515 of 2015 has four previous cases to his credit and this is the 5th case.
5. At this juncture, the learned counsel for the petitioner seeks further time for instructions. Post 'for orders' on 27.03.2015."
3. Today, the Criminal Original Petitions are listed today under the caption "For Orders". When the petitions were taken up for hearing, there was no representation on behalf of the petitioners.
4. The learned Government Advocate(Criminal Side) for the respondent submitted that there are four previous cases against these petitioners.
5. Under such circumstances, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioners.
