To call for the record and set aside the conviction and sentence imposed by the trial court by its judgment passed in Spl.S.C.No.12 of 2019 dated 15.02.2022 on the file of the Mahila court, Pudukkottai and acquit the appellant.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.A.ARUN PRASAD, Advocate for the petitioner and of Government Advocate (Crl. Side) on behalf of the Respondent, the court made the following order:- This petition has been filed praying to suspend the sentence imposed against the petitioner in Spl.S.C.No.12 of 2019 by the Mahila Court, Pudukkottai.
2.It is stated in the petition that the petitioner has been shown as accused in Spl.S.C.No.12 of 2019 and he faced a charge under Section 11(i), 11(iv), r/w 12 of Protection of Children from Sexual Offences Act, 2012. The trial Court has found the accused guilty under Section 11(i), 11(iv), r/w 12 of Protection of Children from Sexual Offences Act, 2012 and sentenced him to undergo three years rigorous imprisonment and to pay a fine of Rs.20,000/- in default to undergo Simple Imprisonment for six months. Crl.M.P(MD).No.3045 of 2022 conviction and sentence passed by the trial Court, Criminal Appeal No.151 of 2022 has been preferred on the file of this Court. 3.Considering the nature of the offence alleged to have been committed by the petitioner/accused and also quantum of punishment imposed against him, this Court is of the view to suspend the sentence imposed in Spl.S.C.No.12 of 2019 till the disposal of Criminal Appeal No.151 of 2022 and also decided to grant bail subject to the following conditions.
4.In view of the above, this petition is allowed and the sentence imposed in Spl.S.C.No.12 of 2019 is alone suspended till the disposal of Criminal Appeal No.151 of 2022 and the petitioner will be released on bail on his executing a bond to the tune of Rs.10,000/- and two sureties, being blood relatives, each for a likesum to the satisfaction of the learned Sessions Judge Mahila Court, Pudukkottai.
