O R D E R

This Writ Petition is filed directing the respondents to pass appropriate orders to re-convey the land in Survey No.1152 of agricultural land situated at Vadaveeranaiakkanpatti, Periyakulam Taluk, Theni District and consequently restore the patta in the name of the petitioner by considering his possession and enjoyment even after the date of prior proceedings for the purpose of establishing District Collectorate by considering the representation dated 15.10.2025.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

The grievance of the petitioner is that the property comprised in S.No.1152 to an extent of 1.23.5 hectares situated at Vadaveeranaiakkanpatti, Peiyakulam Taluk, Theni District, belonging to one Ramacharia. Thereafter, the petitioner's mother purchased the above said land on 23.04.1943 and was doing agricultural work. After demise of her mother, the joint patta was issued in the name of the petitioner and her elder brother namely, Karuppasamy Thevar. In the year 1998, the 2/6

second respondent issued a notice for land acquisition for the purpose of constructing Theni Collector Office and sought an explanation from the said Karuppasamy, who also submitted a detailed explanation. Thereafter, they have been continuously cultivating the said land and enjoying the same for the past 28 years from the year 1998. While so, when the petitioner attempted to obtain a computer patta in order to mortgage the said land with a bank, she came to know that the said agricultural land had been wrongly classified as "Government Poramboke". Hence, the petitioner submitted a representation dated 15.10.2025 seeking rectification of the said mistake. Since no action has been taken till date, the petitioner has been constrained to file the present Writ Petition.

4. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representation dated 15.10.2025 would be considered and appropriate orders would be passed by the first respondent within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of 3/6

with a direction to the first respondent to consider the petitioner's representation dated 15.10.2025 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
