(MD) No.293 of 2021 by its order dated 21.01.2021. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.M.GURUDAS, Advocate for the petitioners and of Mr.M.V.CHANDRASEKARAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition is filed to relax the condition imposed on the petitioners in Crl.O.P.No.293 of 2021 on 21.01.2021.

2. This Court by an order dated 08.03.2021 has sought for some clarification to the respondent police as to why the First Information Report has been registered under Section 304 (ii) of IPC instead of Section 302 of IPC. In view of the same the respondent police has altered the section into 302 of IPC and also produced the alteration report before this Court. In this case charge sheet has been filed after altering the offence into Section 302 of IPC.

4. Taking into consideration of the submissions made by both the counsels, the condition imposed by this court in Crl.O.P.No.293 of 2021 on 21.01.2021 is relaxed. However, the petitioners shall be available before the trial Court on all hearing dates without fail.
