Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus, to call for the records from the 1st respondent in his proceedings in F.No.SGPS80676214 (Legal) Dated 18.12.2018 and QUASH the same and consequently direct the 1st respondent to return the original passport of the petitioner in Passport No.Z2366280 to him within the period stipulated by this Honourable Court.. ORDER:- This Writ Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and the earlier order of this Court dated 19.03.2019 and upon hearing the arguments of Thiru.N.SATHISHBABU, Advocate for the Petitioner and of Thiru.S.JEYASINGH, ADVOCATE FOR R1 AND MR.G.ANBUSARAVANAN, ADVOCATE FOR R4 AND MR.M.KARUPPASAMY, GOVERNMENT ADVOCATE ON BEHALF OF THE RESPONDENTS 2 AND 3, this Court made the following order:

vide order dated 19.03.2019 in W.P(MD).No.845 of 2019. As undertaken before this Court the petitioner had travelled to Singapore, to report his employer and returned. Now, the petitioner wants this Court to relax the condition totally.

2. Since the Criminal case is pending trial against the petitioner, it is only the jurisdictional Criminal Court that can grant permission to travel. Therefore, this Miscellaneous Petition is closed giving liberty to the petitioner to move the jurisdictional Magistrate.

3. The learned counsel appearing for the petitioner states that the petitioner has to necessarily report before his employer on 02.05.2019. Therefore, this Court directs the learned Chief Judicial Magistrate, Pudukottai to dispose of the petition to be filed by the petitioner seeking permission to travel abroad on or before 30.04.2019.
