Respondents Petition filed under Article 226 Constitution of India to issue a Writ of Mandamus to direct the respondents 1 to 4 to take necessary action against the respondents 5 to 7 for excommunicating the petitioner and his family members and further direct the respondents 1 to 4 to ensure that festival of Mazhai mariamman Temple Sendhagudi village Alangudi Tk Pudukottai Dt is conducted by receiving contributions (vari) from all the willing members of Kallar Community of Sendhagudi Village Pudukottai District without any discrimination or any basis and grant adequate protection to the petitioner and his family members for attending the above said temple festival.

ORDER

This writ petition has been filed seeking direction to the respondents 1 to 4 to take action against the respondents 5 to 7 for excommunicating the petitioner.

2.The grievance of the petitioner is that he was prevented by the respondents 5 to 7 who are influential persons in the village from participating in the temple festival. Earlier, when they were indulged in illegal activities, the petitioner has filed writ petition against them, and in order to wreck vengeance, now, they are excommunicating the petitioner from participating in the festival of Mazhai Mariammal Temple. In the above circumstances, the petitioner has submitted a representation dated 07.03.2018 before the respondents. Since no action has been taken, the petitioner has filed the present writ petition.

3.Today, when the matter is taken up for hearing, learned Additional Government Pleader appearing for the respondents 1 to 4 submitted that the Tahsildar, Alangudi Taluk, the third respondent herein is proposing to conduct a peace committee meeting on 26.03.2018 to solve the issue.

4.In the above circumstances, the third respondent is directed to conduct a peace committee meeting on 26.03.2018 and pass appropriate orders, after issuing notice to the petitioner as well as to the respondents 5 to 7 and other interested parties, if any. 5.With the above direction, the writ petition is disposed of. No costs. Consequently, W.M.P(MD)No.5630 of 2018 is closed.
