ORDER

This criminal original petition has been filed to issue suitable directions, directing the learned Special Judge (Special Court constituted under Schedule Caste and the scheduled Tribes Prevention of Atrocities Act, 1989), Madurai District, to consider the bail application on merits and dispose of the bail application on the same day in the event of his surrender, in Crime No.13 of 2026, on the file of the 2nd respondent.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case:

At the instance of the third respondent/defacto complainant, First Information Report in Crime No.13 of 2026 was registered against the petitioner for the offence under Section 296(b), 115(2) & 351(2) of BNS, 2023 and Section 3(1)(r), 3(1)(s) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities), 1989, with respect to default in repaying the borrowed amount, abuse and threat. Hence, the petition. 2/4

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby direct the second respondent police to issue prior notice to the de facto complainant and thereafter, to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No. Crime No.13 of 2026 on the file of the 2nd respondent police. The petitioner shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.

6. Accordingly, this Criminal Original Petition is disposed of. 13.02.2026 NCC : Yes / No Index : Yes / No dss 3/4
