ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 123 and 278 of BNS Act, 2023, in Crime No.12 of 2026, seek anticipatory bail.

2. The case of the prosecution is that the petitioners, along with other accused persons, were in possession of Nitrazepam tablets, which they had purchased online and were selling to customers at a higher price. Hence, the complaint.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the first petitioner has four previous cases and the second petitioner has six previous cases. Therefore, he 2/4

opposed the grant of anticipatory bail to the petitioners.

5. The allegation against the petitioners is that they purchased the tablets, dissolved them in water, and injected the same into the victims. Accused Nos.1 and 4 have already been arrested and released on bail. Considering the heinous nature of the offence, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 11.02.2026 jbr TO
