ORDER

This writ petition has been filed challenging the order passed by the second respondent in Na.Ka.No.06/CO/SVG/2025 dated 27.01.2025 with the consequential direction to the respondents to grant permission and protection for conducting Adal Padal program scheduled to be held on 05.03.2025 from 6.00 pm to 10.00 pm in connection with Thiruvizha at Arulmigu Shri Azhagiya Meiyya Ayyanar Thirukovil situated at Ramalingapuram Village, Madhagupatti Post, Sivagangai District.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the secretary of the festival committee of the temple, namely, Arulmigu Shri Azhagiya Meiyya Ayyanar Thirukovil situated at 2/6

Ramalingapuram Village, Madhagupatti Post, Sivagangai District. While being so, the devotees of the said temple decided to celebrate the temple festival on 05.03.2025. In connection with the temple festival, they also want to conduct the cultural programme, namely, Adal Paadal. Therefore, a representation dated 23.01.2025 was made on behalf of the festival committee, to the second and third respondents, seeking permission and protection for conducting Adal Padal program scheduled to be held on 05.03.2025. However, the same was rejected vide order dated 27.01.2025.

The learned counsel appearing for the petitioner would further submit that the impugned rejection order is not in accordance with law and the petitioner is entitled to conduct the cultural programme in connection with the temple festival. The petitioner also undertakes to conduct the temple festival in a peaceful manner without creating any law and order issue and any obscene acts. Hence, the petitioner filed this writ petition challenging the rejection order. 3/6

The learned Additional Public Prosecutor appearing for the respondents would submit that the representation dated 23.01.2025 was made before the respondents seeking permission for the cultural programme scheduled to be held on 05.03.2025 and the same was rejected on the ground that there may be chances for law and order issue and it will cause hindrance to the traffic. If the petitioner undertakes to conduct the cultural programme without any obscene acts and breach of peace, the respondents will permit the petitioner to conduct the cultural programme.

5. Heard the learned counsel on either side and perused the records placed before this Court.

6. According to the petitioner, the temple festival is scheduled to be held on 05.03.2025. On account of the same, they decided to conduct the cultural programme namely Adal Paadal and thereby, they seek permission from the respondents. However, the same was rejected on 27.01.2025 on the ground that there may be chances for law and order issue. 4/6

Considering the nature of the relief sought for in this writ petition and recording the undertaking given by the petitioner and also considering the facts and circumstances of this case, it is appropriate to grant permission to the petitioner to conduct the cultural programme namely Adal Paadal on 05.03.2025. Accordingly, the impugned order passed by the second respondent dated 27.01.2025 is quashed and the second and third respondents are directed to give permission for the conduct of the temple festival and the cultural programme by imposing appropriate conditions in accordance with law.

8. With the aforesaid directions, this writ petition is disposed of. No costs.
