PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.36 of 2021 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to the judicial custody on 02.02.2023 for the alleged offence punishable under Sections 8(c), 20(b), (ii) (c), 25, and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime 1/3

No.36 of 2021on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 10.05.2021, the law enforcing agency intercepted one two wheeler and one car, which was driven by the accused persons. On search, it was found that they were in possession of 50 kgs of ganja. 3.On 02.04.2024, when this matter was taken up for hearing, no one appeared on behalf of the petitioner and therefore, this Court directed the Registry to list this matter today, ie., 04.04.2024, under the caption "For Dismissal". Today, representing counsel present and submits that the learned counsel on record will appear through video conference. However, there is no representation through video conference.

4.This Court perused the materials on record and also affidavit filed in support of this petition. A perusal of the same reveals that this is third petition for bail and earlier two petitions were dismissed by this Court. There is no change in circumstances.
