PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents to consider the petitioners objection dated 06.07.2016 and 26.06.2017 and thereby remove the retired non-diploma Regular Work Establishment employees names from the seniority list published by the second respondent in Memo No.057043/706/G15/151/2016-1 dated 23.06.2016 and to re-drawn the seniority list as per the Tamil Nadu Electricity Board Service Regulations, every fourth vacancy occurring in the category of Junior Engineer (Mechanical) II Grade, is filled by Non-Diploma Holder by appointment by transfer method from among the employees working in the Regular Work Establishment.

ORDER

Heard Mr.Dayalan, learned counsel, who takes notice for the respondents.

2.By consent of both parties, the main Writ Petition itself is taken up for final disposal at the stage of admission. 3.The writ petitioners herein are working as Foremen Grade-I in TANGEDCO. The promotional avenue available to the petitioners is that of Junior Engineer (Mechanical) Grade-II. In this regard a seniority list has been drawn. The grievance of the petitioners is that certain ineligible persons have also been included in the seniority list. In this regard, the petitioners have given a representation dated 06.07.2016 and followed it up with a reminder dated 26.06.2017.

4.The second respondent is directed to consider the same pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

5.The Writ Petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed.
